Dr. Iraj Derakhshan and Riverside Pharmacy were also named as defendants in the suit.
The acts and omissions of the defendants were not only negligent, but were willfully and blindly reckless and proximately caused Victoria C. Brown’s death on March 21, 2015, according to a complaint filed in Mingo Circuit Court.
Warren L. Brown claims Riverside illegally filled prescriptions for hydrocodone and alprazolan on March 19, 2015, for Victoria Brown. He claims Derakhshan regularly engaged in a pattern and practice of writing prescriptions for controlled substances for non-medical purposes, which violates West Virginia code.
Victoria Brown sought treatment from the defendants and Derakhshan merely wrote prescriptions for controlled substances for non-medical purposes and with no meaningful examination of his patient, according to the suit.
Warren Brown claims the defendants’ actions caused Victoria Brown’s death.
Warren Brown is seeking compensatory and punitive damages. He is being represented by Joseph H. Spano Jr.
