Customer blames Wal-Mart for injuries

BECKLEY — A customer is suing Wal-Mart, alleging its negligence led to her suffering injuries. 

Loretta Gayle Ballard filed a complaint April 21 in Raleigh Circuit Court against Wal-Mart Stores Inc., alleging breach of duty in failing to maintain the store in a reasonably safe condition.

According to the complaint, on June 6, 2016, Ballard sustained serious and permanent injuries to her left shoulder when she fell on a slippery substance at a Wal-Mart in Raleigh County. Ballard says she has suffered physical pain, mental anguish and medical care expenses. 

The plaintiff alleges Wal-Mart Stores failed to properly inspect and clean the area where Ballard slipped.

Ballard seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees court costs and expenses and all other applicable relief. She is represented by attorneys Phillip Estep, Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston.
