Employee blames construction company for unjust terminiation

MOUNDSVILLE — An employee is suing a construction company, alleging wrongful termination after the plaintiff complained about the death of a worker.

Chester Brown filed a complaint May 8 in Marshall Circuit Court against Davis H. Elliot Construction Company Inc. and John Doe, alleging they fired the plaintiff after another worker died on the job.

According to the complaint, Brown suffered monetary damages from being terminated after he complained when a DHE employee was killed on the job and another was injured. The plaintiff alleges the defendants terminated Brown as retaliation for complaining about safety concerns and his age.

Brown seeks trial by jury, punitive damages, interest, damages, legal fees and all other just relief. He is represented by attorneys D. Adrian Hoosier II and Erica Lord of Lord Hoosier PLLC in Charleston.
