Former Sheetz employee says he was wrongfully denied disability benefits

WINFIELD – A Scott Depot man formerly employed by Sheetz Inc. alleges he was wrongfully denied disability benefits.

Troy D. Auvil filed a complaint July 19 in Putnam Circuit Court against Liberty Insurance Co. of Boston alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff applied for short-term disability benefits and was denied by the defendant.

The plaintiff holds Liberty Insurance Co. of Boston responsible because the defendant allegedly arbitrarily denied his entitlement to disability benefits and failed to timely decide on his administrative appeal.

The plaintiff seeks to recover all benefits under the disability plan, plus interest, attorney's fees and costs and such other appropriate relief. He is represented by John J. Polak of Atkinson & Polak PLLC in Charleston.
