Woman alleges Mountain State Oral and Facial Surgery wrongfully terminated her

WINFIELD – A Kanawha County woman alleges she was terminated by her Putnam County employer because she missed work due to medical reasons.

Peggy Marion filed a complaint July 21 in Putnam Circuit Court against Drs. Krajekian, Brock, Hunsaker & Henderson Inc., doing business as Mountain State Oral and Facial Surgery, alleging that they violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff was hired by the defendant in January as an accounts receivable specialist. The suit states she broke her upper left arm on March 17 but the break was not discovered until later. The suit states she was ordered by her doctor not to attend work until she saw an orthopedic physician and missed five days of work in April. She alleges she missed one day of work in June because of a stomach virus and was terminated.

The plaintiff holds Drs. Krajekian, Brock, Hunsaker & Henderson Inc. responsible because the defendants allegedly terminated her employment on the basis of her disability, injury and sickness.

The plaintiff seeks damages in an amount to be determined by jury, plus interest, attorney's fees, costs and such other relief as the court deems appropriate. She is represented by Daniel L. Holstein of Holstein Law Office in St. Albans. The case has been assigned to Phillip M. Stowers.
