Life insurance beneficiary seeks allegedly unpaid benefits from Globe Life and Accident Insurance

WINFIELD – A Hometown resident alleges that her insurer wrongfully denied her benefits from a life insurance policy.

Judy C. Lovejoy filed a complaint July 20 in Putnam Circuit Court against Globe Life and Accident Insurance Co. alleging that the licensed insurer violated the West Virginia Unfair Trade Practices Act.

According to the complaint, the plaintiff is the beneficiary and owner of a life insurance policy issued on the life of her husband, Roy Thomas Lovejoy. The suit states the plaintiff made a timely claim for the death benefits payable under the policy but that the defendant denied the claim in May.

The plaintiff holds Globe Life and Accident Insurance Co. responsible because the defendant allegedly failed to conduct proper and prompt investigation on her claim and wrongfully refused to pay the policy proceeds to which she is entitled.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount that will fully compensate her for her damages she sustained, punitive damages, attorney's fees, costs and interest. She is represented by Harvey D. Peyton of Peyton Law Firm PLLC in Nitro. The case has been assigned to Circuit Judge Joseph Reeder.
