HUNTINGTON – A Kentucky man alleges that he was injured at a Barboursville restaurant by an empty plate.

Steve D. Long filed a complaint on July 14 in the Cabell Circuit Court against Chili's of West Virginia Inc., doing business as Chili's Grill & Bar, and Cassidy Beaver alleging negligence.

According to the complaint, the plaintiff alleges that on July 19, 2015, he was dining at Chili's and Beaver was his server. He alleges he was injured when Beaver struck him in the elbow with an empty plate.

The plaintiff holds Chili's of West Virginia Inc. and Beaver responsible because Chili's allegedly failed to properly train its employees on how to safely serve its patrons.

The plaintiff seeks judgment against the defendants in an amount that will adequately compensate the plaintiff for his damages, interest, court costs and any further relief the court grants. He is represented by Kenneth P. Hicks and D. Geoffrey Varney of Kenneth P. Hicks LC in Huntington. The case has been assigned to Circuit Judge Paul T. Farrell.
