Former GGNSC St. Albans worker alleges he was terminated because he missed work due to strep throat

CHARLESTON – A man alleges he was terminated from his employment at a health care facility because he missed work because of a bacterial infection.

Jason Mullins filed a complaint on July 17 in the Kanawha Circuit Court against GGNSC St. Albans LLC, Adrianna Mynhier and Michael Laughery alleging violating of the West Virginia Patient Safety Act.

According to the complaint, the plaintiff alleges he was employed by the defendants as a certified nursing assistant from 2014 until his involuntary termination on Aug. 27, 2015. He alleges he contacted Mynhier prior to his termination to tell her he had strep throat and told her he should stay home so he could avoid spending the disease to the residents. He alleges he terminated because he did not attend a work meeting while he was sick.

The plaintiff holds GGNSC St. Albans LLC,  Mynhier and Laughery responsible because the defendants allegedly refused plaintiff's doctor's excuse and instead terminated his employment.

The plaintiff seeks general damages, punitive damages, all legal fees and interest. He is represented by Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston. The case has been assigned to Circuit Judge Tod Kaufman.
