Ditech Financial seeks release of deed of trust

CHARLESTON – A mortgage holder and servicer is seeking the release of a deed of trust.

Ditech Financial LLC filed a complaint for release of deed of trust July 27 in Kanawha Circuit Court against Fleetwood Homes Inc.

According to the complaint, the closing for a mortgage loan refinance transaction on a Charleston property was completed in August 2004 and a portion of those proceeds was used to pay a debt to defendant. The suit states this was secured by a deed of trust.

The plaintiff alleges that it is the current holder of the note and deed of trust and request that it be released so it may become the first lien on the property.

The plaintiff seeks an order for the release of defendant's deed of trust dated April 6, 2004, and recorded in Deed of Trust Book 3162, Page 181 in the office of Clerk of Kanawha County Commission; and any further relief as the court deems appropriate. It is represented by Christopher A. Dawson of Reisenfeld & Associates LPA LLC in Cincinnati, Ohio. The case has been assigned to Circuit Judge Carrie L. Webster.
