Stonerise Healthcare, Keyser Center named in wrongful death suit

KEYSER – An estate administrator of a former resident of a Keyser long-term care facility alleges her decedent suffered injuries while in its care.

Susan K. Oates, as executrix for the estate of Donna M. Wagoner, filed a complaint Aug. 9 in Mineral Circuit Court against Stonerise Healthcare LLC; Keyser Center LLC, doing business as Piney Valley; ABC Business Entities 1-10; John Doe nursing care providers; and John Doe controlling officers, managing members and general partners 1-10 citing violation of West Virginia codes, negligence and wrongful death.

According to the complaint, the plaintiff alleges that Wagoner suffered bodily injury and pain and suffering while in the defendants' care before her death in 2016.

The plaintiff holds the defendants responsible because the defendants allegedly failed to properly hire and train staff to ensure compliance with applicable care and standards, failed to provide a safe environment and failed to adequately assess Wagoner's needs.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, punitive damages, interest, court costs and any further relief the court grants. She is represented by Colin M. Esgro of Wilkes & McHugh PA in Pittsburgh, Pennsylvania.
