Former Republic Services Alliance Group driver alleges FMLA interference

HUNTINGTON – A Cabell County man alleges that he was terminated in retaliation from his position as a truck driver because of his requests to take a leave.

Richard Collins filed a complaint Aug. 9 in U.S. District Court for the Southern District of West Virginia, Huntington Division against Republic Services Alliance Group Inc. alleging violation of the West Virginia Human Rights Act and the Family and Medical Leave Act.

According to the complaint, the plaintiff began working for the defendant in June 2013 as a truck driver and in 2015, inquired about taking FMLA leaves to care for his mother and for medical needs. The suit states the defendant "mistakenly represented" to the plaintiff that he did not qualify for FMLA leave and terminated him.

The plaintiff holds Republic Services Alliance Group Inc. responsible because the defendant allegedly deliberately failed to provide proper and accurate notice and interfered with the plaintiff's FMLA rights.

The plaintiff requests a trial by jury and seeks back wages, liquidated damages, reinstatement and/or front pay, litigation costs, attorney's fees and all other remedies as the court deems fair and proper. He is represented by Hoyt Glazer of Law Office of Hoyt Glazer PLLC in Huntington.
