Cliffs Logan County Coal alleged to have failed to pay wages in timely manner

LOGAN – A Logan County man alleges that his former employer failed to pay him in a timely manner.

Jody L. Simpson filed a complaint on Sept. 6 in the Logan Circuit Court against Cliffs Logan County Coal LLC citing the West Virginia Wage Payment and Collection Act.

According to the complaint, the plaintiff alleges he was an employee of the defendant until his involuntary termination in December 2013. He alleges at the time of his termination, he was still owed wages for work performed.

The plaintiff holds Cliffs Logan County Coal LLC responsible because the defendant allegedly failed to timely pay all wages due to the plaintiff.

The plaintiff seeks compensatory damages, all damages, liquidated damages, outstanding wages, court costs, interest and any further relief the court grants. He is represented by Jeffrey A. Foster, Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston. The case has been assigned to Circuit Judge Eric H. O'Briant.
