CHARLESTON – A former nursing director for a Kanawha County drug treatment center alleges she was not paid in a timely manner after she was discharged.
Laura Fragale filed a complaint in Kanawha Circuit Court against New Beginnings Drug Treatment Center Inc., William Mucklow, Ethel Fleming, et al. alleging that they violated the West Virginia Wage Payment and Collection Act.
According to the complaint, the plaintiff was employed by the defendants from Aug. 1, 2016, to May 4, 2017.
The plaintiff holds New Beginnings Drug Treatment Center Inc., Mucklow, Ethel Fleming, et al. responsible because the defendants allegedly breached their duties to pay all wages that she was owed in full and before the next regular payday after she was discharged.
The plaintiff requests a trial by jury and seeks unpaid wages due, liquidated damages, attorney's fees, costs and pre- and post-judgment interest. She is represented by Michael P. Addair and Todd S. Bailess of Bailess Smith PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
