Baisden couple alleges orthopaedic surgeon negligently used incorrect devices

LOGAN – A Baisden couple alleges an orthopaedic surgeon used mismatched and/or unacceptable knee implants for the husband's surgeries.

Terry K. Cline and Theresa Cline filed a complaint Sept. 11 in Logan Circuit Court against Robert McCleary, DO alleging negligence.

According to the complaint, the plaintiffs allege that plaintiff Terry Cline underwent both knee arthroplasties performed by defendant in 2012 and 2014, but his knees continued to be in severe pain and he was limited in his mobility. The suit states that in Sept. 23, 2016, Terry Cline underwent a left knee replacement where it was discovered that the parts used by defendant were not proper to use. The suit states that the parts used in the right knee also were not the proper ones.

The plaintiffs holds McCleary responsible because the defendant allegedly failed to use appropriate and proper implant equipment and negligently used mismatched or unacceptable knee implants during the operations.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount that will adequately compensate them for their damages and any further relief as may be proper under the law. They are represented by Robert V. Berthold Jr. and Matthew C. Berthold of Berthold Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Joshua Butcher.
