Homeowners say Erie Insurance mishandled house fire claim

CHARLESTON – Homeowners allege their insurer has delayed coverage for their claim after a house fire.

Matthew Brogan and Rhonda Brogan filed a complaint Sept. 12 in Kanawha Circuit Court against Erie Property and Casualty Insurance Co. and Stephen Myers alleging breach of contract and other counts.

According to the complaint, the plaintiffs allege that on Dec. 16, 2016, their home was destroyed by fire. They allege they had a policy issued by Erie and that Myers was the adjuster for the claim.

The plaintiffs holds Erie Property and Casualty Insurance Co. and Myers responsible because the defendants allegedly wrongly and intentionally delayed, denied and mishandled the plaintiff's claim and required the plaintiffs to get multiple estimates for the same damage in violation of state policy.

The plaintiffs request a trial by jury and seek an order for defendant to provide their benefits due under the policy, payment for damages, plus interest attorney's fees, costs and all other relief to which they are entitled to receive. They are represented by Erica Lord of Loed Hoosier PLLC in Charleston. The case has been assigned to Circuit Judge Louis H. Bloom.
