Motorist alleges Dollar General employee improperly made a left-hand turn, caused collision

MOUNDSVILLE – A Moundsville couple is seeking damages after a collision with a Dollar General employee.

Donald McIlvain and Carol McIlvain filed a complaint Sept. 12 in Marshall Circuit Court against Dolgencorp LLC, doing business as Dollar General and Ronald A. Brock alleging negligence.

According to the complaint, on Sept. 17, 2015, Donald McIlvain was operating his motor vehicle traveling northbound on West Virginia Route 2 when defendant Brock, an employee of defendant Dollar General, attempted to make a left turn and caused plaintiff to strike the defendants' vehicle. The plaintiff alleges he sustained injuries resulting in pain and suffering, inconvenience, aggravation and impairment of capacity to enjoy life. 

The plaintiffs holds Dolgencorp LLC and Brock responsible because defendant Brock allegedly improperly made a left turn into the path of the plaintiff's vehicle and failed to yield right of way.

The plaintiffs seek compensatory damages in an amount to be determined by jury, attorney's fees and costs. They are represented by Christopher M. Turak of Gold, Khourey & Turak LC in Moundsville. The case has been assigned to Circuit Judge Jeffrey Cramer.
