Motorist seeks damages from Brewer & Co. of West Virginia after Nitro collision

CHARLESTON – A Kanawha County woman alleges that her vehicle was struck by a van owned by a fire protection contractor servicer when it ran a red light.

Rebecca Underwood filed a complaint Sept. 18 in Kanawha Circuit Court against Brewer & Co. of West Virginia Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 20, she was driving on First Avenue in Nitro when she was struck by defendant's cargo van, which had run a red light. 

She alleges she sustained serious bodily injuries resulting in economic and non-economic damages, medical related expenses and physical and mental pain. 

The plaintiff holds Brewer & Co. of West Virginia Inc. responsible because the defendant's driver allegedly recklessly operated the motor vehicle by failing to obey a traffic signaling device.

The plaintiff requests a trial by jury and seeks all damages, plus interest, attorney's fees, costs and expenses and all further relief that the court may deem just and proper. She is represented by Russel A. Williams of Katz, Kantor, Stonestreet & Buckner PLLC in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
