BECKLEY – A Beckley consumer alleges a pickup truck he purchased does not conform to the warranties and seeks a refund.
Richard W. Miller filed a complaint Sept. 19 in Raleigh Circuit Court against General Motors LLC alleging that the automobile manufacturer violated West Virginia Code.
According to the complaint, the plaintiff alleges that on Sept. 25, 2015, he purchased a used 2014 Chevrolet Silverado from defendant's authorized dealer for $40,499. After purchase, he alleges he experienced defects with the motor vehicle and that such defects substantially impaired its use, value and safety.
The plaintiff holds General Motors LLC responsible because despite reasonable number of attempts, the defendant allegedly failed to make repairs in a good and workmanlike manner so as to conform the subject vehicle to the warranties.
The plaintiff requests a trial by jury and seeks revocation of acceptance and refund of the purchase price, damages for loss of use and costs of repairs of the vehicle, attorney's fees and such other relief that are appropriate. He is represented by Anthony M. Salvatore of Hewitt & Salvatore PLLC in Fayetteville. The case has been assigned to Circuit Judge Andrew Dimlich.
