Man seeks damages from the city of Grafton after fall on steps

GRAFTON – A man alleges negligently constructed steps located near a street in Grafton caused him to trip and fall.

Mark Reynolds filed a complaint Sept. 22 in Taylor Circuit Court against the City of Grafton alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 14, 2016, he was descending a set of concrete steps at 339 W. Washington Street when he lost his balance and fell. He alleges he reached for the handrail to catch himself, but the handrail broke free from the concrete and failed to assist him. He also alleges that the steps were not level.

He alleges he sustained severe bodily injuries resulting in physical and mental pain, loss of income and benefits, aggravation and other consequential and incidental damages. 

The plaintiff holds the city of Grafton responsible because the defendant allegedly failed to conform the subject steps and its handrails to the building code and/or the Occupational Safety and Health Administration regulations.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages sustained by plaintiff, plus interest, costs and attorney's fees and all other relief as the court deems proper. He is represented by Kevin T. Tipton of Tipton Law Offices in Fairmont. The case has been assigned to Circuit Judge Alan D. Moats.
