Woman says Rainbow Tavern negligently entrusted man with vehicle

MOUNDSVILLE – A Marshall County woman alleges a Glen Dale business failed to train a Moundsville man and that she was damaged as a result.

Darlene Mitcham filed a complaint Sept. 26 in Marshall Circuit Court against Timothy Caleb Stanley, Rainbow Tavern LLC and Jason Emmett Morris alleging negligence.

According to the complaint, the plaintiff alleges that Rainbow Tavern negligently entrusted its vehicle to Morris, who had a suspended and/or revoked driver's license.

She alleges she has suffered damages for physical injuries, property damage, aggravation, inconvenience and emotional distress. 

The plaintiff holds Stanley, Rainbow Tavern LLC and Emmett Morris responsible because the defendant Rainbow allegedly failed to properly train and/or supervise defendant Morris in the operation of the vehicle.

The plaintiff requests a trial by jury and seeks compensation for her injuries, damages and losses; attorney's fees; and costs, interest and all other relief that are fair, equitable and appropriate. She is represented by Herman D. Lantz of Lantz Law Offices in Moundsville. The case has been assigned to Circuit Judge Jeffrey Cramer.
