HUNTINGTON — Two Huntington tenants are suing a landlord and a county sheriff, alleging breach of a lease agreement that cost them their property.
Danielle Toney and Scott Moore filed a complaint Sept. 29 in Cabell Circuit Court against Sovereign Group LLC and Cabell County Sheriff Charles Zerkle, alleging they failed to fulfill the implied warranty of habitability.
According to the complaint, on Oct. 27, 2016, as a result of the defendants' wrongful conducts, Toney and Moore were deprived of their leasehold and use of their personal property at 1812 Kite St., Huntington. The plaintiffs allege the defendants failed and refused to repair the defects in the property, wrongfully evicted Toney and Moore by ignoring the court's order, dispossessed the plaintiffs from their leasehold and personal properties and failed and refused to pay the amount granted by the court to the plaintiffs.
Toney and Moore seek trial by jury, damages in excess of the jurisdictional limits of the court, plus interest, court costs, attorney fees and all other relief the court deems just and proper. They are represented by attorney J. William St. Clair of Legal Aid of West Virginia in Huntington.
