Woman alleges she was victim of sexual harassment while working at Wendy's

CHARLESTON – A former employee of a Wendy's franchise alleges that she was forced to quit her job because of sexual harassment from a co-worker.

Sara Wilson filed a complaint Sept. 28 in Kanawha Circuit Court against Wendschmidt WV Inc., Tammy R. Harrison and John Doe citing the West Virginia Human Rights Act.

According to the complaint, the plaintiff was employed at the defendants' Cross Lanes location. She alleges that she experienced sexual harassment from her a co-worker and reported it to Doe and Harrison, which refused to address the issue. She alleges she quit her job in January 2016 because of the hostile work environment.

The plaintiff holds Wendschmidt WV Inc., Harrison and Doe responsible because the defendants allegedly knew that the plaintiff was experiencing sexual harassment from a co-worker but failed to address or take certain actions to rectify the problem.

The plaintiff requests a trial by jury and seeks judgment against the defendants, all remedies, interest, court costs and any further relief the court grants. She is represented by Robert P. Lorea of Lorea Law Office PLLC in Charleston and Rodney A. Smith and Todd S. Bailess of Bailess Smith PLLC in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
