ProBuild Co. alleges it is owed more than $17,000 from G&G Builders

CHARLESTON – A Scott Depot contractor is alleged to have failed to pay for materials purchased for a project.

ProBuild Co. LLC, doing business as Builders FirstSource, filed a complaint Oct. 5 in Kanawha Circuit Court against G&G Builders Inc. and Steven Ghareeb citing breach of contract and other counts.

According to the complaint, the plaintiff alleges that between March 8 and May 11, plaintiff supplied building materials to defendants' project in Charleston. As of the filing of this complaint, the amount of $17,977.30, allegedly remains due and owing. 

The plaintiff holds G&G Builders Inc. and Ghareeb responsible because the defendants allegedly accepted, taken possession and enjoyed the benefits of the materials provided by plaintiff without paying the same.

The plaintiff requests a trial by jury and seeks compensatory damages of $17,977.30, plus interest, attorney's fees, costs and any further relief as the court may deem proper. It is represented by Tracey A. Rohrbaugh and Patrick C. Timony of Bowles Rice LLP in Charleston. The case has been assigned to Circuit Judge Charles E. King.
