Weirton couple alleges insurers failed to pay for actual covered losses from house fire

NEW CUMBERLAND – A Weirton couple alleges their insurers have failed to adequately compensate them for losses sustained in a fire.

John Brun and Alissa Brun filed a complaint Oct. 10 in Hancock Circuit Court against Horace Mann Insurance Co. and Teachers Insurance Co. alleging breach of contract and other counts.

According to the complaint, the plaintiffs allege that on Aug. 29, they sustained property damage when a fire occurred at their residence. They allege they advised defendants of the loss and the defendants offered $199,003.70. The plaintiffs allege the losses covered under their policy were higher than the amount offered.

The plaintiffs hold Horace Mann Insurance Co. and Teachers Insurance Co. responsible because the defendants allegedly have failed and/or refused to pay plaintiffs for their actual covered losses.

The plaintiffs request a trial by jury and seek declaration of their rights under the policy, award for compensatory and punitive damages, plus interest, costs, attorney's fees and any further relief that the court may deem just and proper. They are represented by Mark A. Colantino of Fitzsimmons Law Firm PLLC in Wheeling. The case has been assigned to Circuit Judge Jason A. Cuomo.
