MOUNDSVILLE – A Cameron man and a construction company are alleged to have failed to pay in full for the purchase of equipment.
John Deere Construction and Forestry Co. filed a complaint Oct. 10 in Marshall Circuit Court against Q&M Construction Inc. and Timothy S. McCurdy alleging failure to pay.
According to the complaint, the plaintiff alleges that on Dec. 30, 2013, it sold a used John Deere 120D Excavator to defendants for a total price of $123,500. To date, the balance of $45,343.36 allegedly remains due and owing.
The plaintiff also alleges that the defendants owe $20,000 on a revolving charge account.
The plaintiff holds Q&M Construction Inc. and Timothy S. McCurdy responsible because the defendants allegedly failed to make monthly payments as required under the contract.
The plaintiff seeks immediate possession of the equipment, payment for the balance of the contract, plus interest, costs and expenses and any further relief as may be proper and just. It is represented by W. Bradley Sorrels of Robinson & McElwee PLLC in Charleston.
