Man alleges Liberty Life Assurance Co. of Boston wrongfully terminated disability benefits

CLARKSBURG – A Weirton man formerly employed by Pratt & Whitney alleges that he is disabled and that his disability benefits were wrongfully terminated by an insurance company.

Richard Figlioli filed a complaint Oct. 10 in U.S. District Court for the Northern District of West Virginia against the Liberty Life Assurance Co. of Boston and Group Life Insurance Plan of United Technologies Corp. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on March 7, he stopped receiving his long-term disability benefits from the defendants after receiving benefits for eight years. 

The plaintiff holds Liberty Life Assurance Co. of Boston and Group Life Insurance Plan of United Technologies Corp. responsible because he is allegedly disabled according to the terms of the plan and that they also allegedly failed to provide requested plan documents.

The plaintiff seeks award for retroactive long-term disability benefits and reinstatement of future benefits, costs of this action and any further relief as may be just and proper. He is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh, Pennsylvania.
