Estate executor seeks to sue Huntington Health Rehab operators

HUNTINGTON – An estate administrator of a former resident of a Huntington skilled nursing facility alleges her decedent suffered injuries there.

Paula Slone, on behalf of the estate of Melvin Slone, filed a complaint Oct. 19 in Cabell Circuit Court against Canyon Sudar Partners LLC, SVCare Holdings LLC, Sava Senior Care LLC, et al. seeking declaratory relief.

According to the complaint, Melvin Slone was a resident of Huntington Health Rehab in Huntington from April to December 2016. The plaintiff alleges he suffered injuries and damages while residing there.

The suit states that an alleged arbitration agreement was signed on Melvin Slone's behalf when he was admitted to the defendants' facility, and she anticipates that the defendants will try to enforce the purported agreement.

The plaintiff seeks an order declaring that no valid agreement to arbitrate exist in this matter and plaintiff may bring an action for the alleged injuries suffered by Melvin Slone and such other relief as the court may deem just and proper. She is represented by James B. McHugh, Michael J. Fuller Jr. and D. Bryant Chaffin of McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi. The case has been assigned to Circuit Judge Paul T. Farrell.
