Consumer claims David Trump Design never delivered furniture

BECKLEY – A Raleigh County consumer alleges he paid for furniture that was never delivered.

Michael Quesenberry filed a complaint Oct. 23 in Raleigh Circuit Court against David Trump III, doing business as David Trump Design, alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that on Oct. 24, 2014, he ordered and paid for furniture and some fabric from defendant for a total cost of $38,198. After not receiving the majority of the items for more than six months, plaintiff canceled the orders and demanded a full refund of the funds. He says he has not received any refund. 

The plaintiff holds Trump III responsible because the defendant allegedly failed to deliver the ordered items and retained the funds without providing the items ordered.

The plaintiff seeks restitution of the funds that is rightfully due to him in the amount of $38,198, compensatory damages of $10,000 and punitive damages of $10,000. He is represented by W. Bradley Sorrells of Robinson & McElwee PLLC in Charleston. The case has been assigned to Circuit Judge Andrew Dimlich.
