Former Raleigh County employee files suit over termination

BECKLEY – A Raleigh County man formerly employed by the Raleigh County Assessor's Office alleges he was wrongfully terminated.

Curtis Dean Bias filed a complaint Oct. 23 in Raleigh Circuit Court against the Raleigh County Assessor's Office and the County Commission of Raleigh County alleging wrongful termination.

According to the complaint, the plaintiff was employed by the defendants in the county's mapping division and was directly supervised by his mother, however Paul Flanagan was appointed as the person to make decisions regarding salary, promotion, termination or discipline regarding the plaintiff.

The plaintiff alleges only Flanagan could terminate his employment, but the County Commission of Raleigh County terminated the plaintiff's employment on Oct. 4, 2016.

The plaintiff alleges the County Commission of Raleigh County lacked the authority to terminate him.

The plaintiff requests a trial by jury and seeks all damages, prejudgment interest, costs and attorney's fees and any other relief that the court deems just and proper. He is represented by Kyle G. Lusk, Matthew A. Bradford and Brandon L. Gray of Lusk & Bradford PLLC in Beckley. The case has been assigned it Circuit Judge Andrew Dimlich.
