Matewan alleged to owe more than $400,000 for services on water, wastewater plants

CHARLESTON – A Boston company alleges a Mingo County town owes more than $400,000 for water and wastewater treatment services.

Veolia Water North America Operating Services LLC filed a complaint Oct. 23 in U.S. District Court for the Southern District of West Virginia, Charleston Division against the town of Matewan alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that in Nov. 15, 2001, the plaintiff agreed to maintain defendant's water treatment plant and distribution system, a wastewater treatment plant and collection system and floodwalls for an annual fee of $413,000, which was subject to negotiation each year. As of Oct. 23, 2017, the amount of $434,533.45 allegedly remains due and owing. 

The plaintiff holds the town of Matewan responsible because the defendant allegedly has failed to satisfy its obligations under the agreement by failing to pay all sums due and owing to plaintiff, including interest.

The plaintiff requests a trial by jury and seeks compensatory damages, plus interest, reasonable attorney's fees, costs of court and such other relief as the court deems appropriate. It is represented by Floyd E. Boone Jr. and Patrick C. Timony of Bowles Rice LLP in Charleston.
