Motorist seeks uninsured/underinsured motorist benefits from State Farm

CHARLESTON – A Cameron man alleges he is entitled to additional insurance coverage after an accident in Pennsylvania.

Joseph R. Pettit filed a complaint Oct. 24 in Kanawha Circuit Court against State Farm Mutual Automobile Insurance Co. and Angela Cooke alleging breach of contract.

According to the complaint, the plaintiff alleges that on Sept. 23, 2009, he was injured when an uninsured/underinsured motorist Mark Lorenz fell asleep and caused a head-on collision with his vehicle in Pennsylvania. He alleges he has incurred costs of more than $100,000 for medical expenses.

The plaintiff holds State Farm Mutual Automobile Insurance Co. and Cooke responsible because the defendants allegedly failed to make the plaintiff whole by only offering $40,000 for coverage. He alleges he is entitled to collect uninsured/underinsured motorist benefits from State Farm.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, attorneys' fees, costs and any additional relief as the court may deem just and proper. He is represented by Brent K. Kesner and Ernest G. Hentschel II of Kesner & Kesner PLLC in Charleston and Gregory A. Gellner of Gellner Law offices in Wheeling. The case has been assigned to Circuit Judge James C. Stucky.
