Estate administrator alleges Hilltop Center failed to provide proper care to decedent

FAYETTEVILLE – An estate administrator has filed suit against a Fayette County nursing facility over allegations it failed to address her decedent's hypotension.

Deana Bennett, as administrator of the estate of JoAnn Stevenson, filed a complaint Oct. 30 in Fayette Circuit Court against Saddle Shop Road Operations LLC, doing business as Hilltop Center, alleging violation of the West Virginia Medical Professional Liability Act.

According to the complaint, the plaintiff alleges that on March 11, 2016, plaintiff's decedent JoAnn Stevenson was admitted to Hilltop Center for rehabilitation. The suit states Stevenson was found unresponsive in the morning of March 24, 2016, and was later pronounced dead at Plateau Medical Center. 

The plaintiff holds Saddle Shop Road Operations LLC responsible because the defendant's employees, agents and/or representatives allegedly breached their duties to exercise reasonable care, skill and ability in treating Joann Stevenson by failing to promptly address decedent's hypotension and by failing to accurately assess her neurological status.

The plaintiff requests a trial by jury and seeks all damages, plus interest, costs and attorneys' fees and all other relief to which plaintiff is lawfully entitled. She is represented by Kathy A. Brown and Timothy D. Houston of Brown | Houston PLLC in Charleston. The case has been assigned to Circuit Judge Paul M. Blake Jr.
