LOGAN – A registered nurse alleges she was wrongfully terminated by a Logan nursing home.
Evelyn Frye filed a complaint Oct. 30 in Logan Circuit Court against Trinity Health Care Services of Logan Inc. and Trinity Health Care Services Inc. alleging retaliatory discharge.
According to the complaint, on June 8, two residents reported to the plaintiff that they had not received their medication. She alleges she reported it to a licensed practical nurse on the staff and alleges she later observed the LPN mentally abusing a resident. The suit states she reported the conduct to the defendants and that no investigation was conducted. She alleges she was terminated June 20 in retaliation for the reports.
The plaintiff holds Trinity Health Care Services of Logan Inc. and Trinity Health Care Services Inc. responsible because the defendants allegedly failed to conduct any investigation concerning elder abuse and retaliated against her and terminated her employment for making a good faith report of instances of defendants' wrongdoing to appropriate authorities.
The plaintiff requests a trial by jury and seeks punitive damages, attorneys' fees and any other relief that is just and proper. She is represented by Maria W. Hughes and Mark Goldner of Hughes & Goldner PLLC in Charleston. The case has been assigned to Circuit Judge Joshua Butcher.
