Patient alleges injuries after surgeries by CAMC physician

CHARLESTON – A Logan County woman alleges she suffered injuries after surgeries performed by an employee of a Charleston medical center.

Nancy L. Barker filed a complaint Oct. 31 in Kanawha Circuit Court against Charleston Area Medical Center Inc. alleging a violation of the standard of care.

According to the complaint, the plaintiff was referred to Dr. Samuel C. Rossi, an employee of the defendant, in January 2015 for surgery on a right anterior diaphragmatic hernia. The suit states two surgeries were performed in February 2015 and April 2016. She alleges she was injured as a result of the surgeries.

The plaintiff holds Charleston Area Medical Center Inc. responsible because the defendant's employee allegedly failed to repair the diaphragmatic hernia during the first surgery, failed to identify and take appropriate measure to protect the pericardium and heart during the hernia repair and failed to recognize early post-operative signs of iatrogenic cardiac injury.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, economic and non-economic damages and any further relief as permitted under the law. She is represented by Arden J. Curry II of Pauley Curry PLLC in Charleston.
