PHILIPPI – A Philippi man alleges he was struck by a car driven by a B's Recovery Service employee.
Terry S. Bradley filed a complaint Nov. 2 in Barbour Circuit Court against Doyle McBee, Toni McBee, B's Recovery Services and John Does 1-5 alleging negligence.
According to the complaint, the plaintiff alleges that on Nov. 5, 2015, he was injured when Doyle McBee backed up a Dodge Avenger and accelerated towards him, striking him below the knee, causing him to fall and strike his head onto the concrete parking lot. He alleges he suffered an abrasion on the back of his head and other physical injuries and damages.
The plaintiff holds Doyle McBee, Toni McBee, B's Recovery Services and John Does 1-5 responsible because defendant Doyle McBee, who was acting in the course and scope of his employment with defendants Toni McBee and B's Recovery, allegedly struck him with the Dodge Avenger while in the process of repossessing it.
The plaintiff requests a trial by jury and seeks general, compensatory and punitive damages, pre- and post-judgment interest, costs and attorneys' fees and such other specific and general relief. He is represented by Hunter B. Mullens and Matthew L. Ervin of Mullens & Mullens PLLC in Philippi.
