Marksman Contracting alleges it is still owed more than $20,000 for septic work

KINGWOOD – A Terra Alta business claims an Elkins business failed to pay in full for work it completed.

Marksman Contracting LLC filed a complaint Nov. 1 in Preston Circuit Court against Smoke on the Water LLC and Jonathan Magee alleging breach of contract.

According to the complaint, the plaintiff alleges that on May 22, 2016, the defendants contracted the plaintiff to install a septic system at defendants' property for a total sum of $92,835.07. To date, the balance amount of $26,638 allegedly remains due and unpaid. 

The plaintiff seeks judgment against defendants jointly and severally, for the sum of $26,638, plus litigations costs, attorney fees and any further relief that the court may deem just and proper. It is represented by Phillip M. Magro of Magro and Magro in Morgantown. The case has been assigned to Circuit Judge Lawrance S. Miller Jr.
