GRAFTON – A Mingo County man is seeking damages from a Newburg company and its employee after a multi-vehicle collision in Grafton.
Mark Chaston Cline filed a complaint Nov. 7 in Taylor Circuit Court against Zachary Nolan and Jennings Excavation Inc. alleging negligent/reckless conduct.
According to the complaint, the plaintiff alleges that on Nov. 19, 2015, he was driving his motor vehicle traveling east on Route 50 in or around Grafton when defendant Nolan, who was operating a large utility truck owned by defendant Jennings, recklessly fell asleep and hit the vehicle in front of him, pushing it into another vehicle that in turn struck the plaintiff's vehicle.
As a result, the plaintiff alleges he sustained severe injuries resulting in medical expenses, pain and suffering, lost wages and other consequential damages.
The plaintiff holds Nolan and Jennings Excavation Inc. responsible because defendant Nolan allegedly failed to maintain proper control of the vehicle he was driving.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, attorney's fees, costs and expenses and all further relief that the court deems appropriate.
