Former Thomas Health Systems employee alleges age discrimination

CHARLESTON – A Charleston woman alleges she was terminated by her South Charleston employer because of her age.

Kathy Asbury filed a complaint Nov. 8 in Kanawha Circuit Court against THS Physicians Partners Inc. and Thomas Health Systems Inc. alleging that they violated the West Virginia human Rights Act.

According to the complaint, the plaintiff alleges that during her employment with the defendants, she was subjected to an intimidating, hostile and offensive working environment. She also alleges that she was terminated from her employment on Aug. 25 because of her age.

The plaintiff holds THS Physicians Partners Inc. and Thomas Health Systems Inc. responsible because the defendants allegedly terminated her and replaced her with a younger employee that did not have the plaintiff's management skills and experience.

The plaintiff seeks general and punitive damages, litigation costs and any further relief that is just and proper. She is represented by John Einreinhofer of Law Offices of John Einreinhofer in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
