Man alleges West Virginia Division of Corrections failed to provide timely medical care

CHARLESTON – A man alleges a delay in receiving medical treatment while he was incarcerated caused him permanent injury.

Lance R. Breckenridge filed a complaint Nov. 8 in Kanawha Circuit Court against West Virginia Division of Corrections and the West Virginia Department of Military Affairs and Public Safety alleging negligence.

According to the complaint, the plaintiff was incarcerated and resided at the Huntington Work Release Center in October 2015. He alleges he began experiencing stroke-like symptoms on Oct. 16, 2015, and was not taken to a hospital until the following day where it was determined he had suffered an acute stroke. He alleges that because of the delay in care, he was unable to receive stroke treatments that could prevent permanent injury.

The plaintiff holds West Virginia Division of Corrections, West Virginia Department of Military Affairs and Public Safety responsible because the defendants allegedly breached their duties to exercise reasonable care and were negligent in ignoring his symptoms.

The plaintiff requests a trial by jury and seeks compensatory and general damages, plus interest and all further relief as the court may deem just and proper. He is represented by Michael A. Olivio and Stephanie H. Daly of Olivio Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Louis H. Bloom.
