Former resident of Beckley nursing home files suit over injuries

BECKLEY – A Raleigh County woman alleges a Beckley nursing home's negligence caused her injuries.

Delois J. Tate filed a complaint Nov. 14 in Raleigh Circuit Court against Riparian Investments LLC, doing business as Harper Mills, and Stonerise Healthcare LLC alleging negligence.

According to the complaint, the plaintiff alleges that between July 29, 2016, and August 4, 2016, she was a resident at defendants' nursing home facility. The suit states that while residing there, she suffered a dislocation of her left hip arthroplasty, which required surgical intervention.

The plaintiff holds Riparian Investments LLC and Stonerise Healthcare LLC responsible because the defendants allegedly failed to provide sufficient number of staff and supplies to meet residents' needs and failed to provide health care services in compliance with state law.

The plaintiff requests a trial by jury and seeks all damages, attorney's fees, costs and any further relief as the court sees fit to award. She is represented by Jeff D. Stewart and Andrew L. Paternostro of Stewart Bell PLLC in Charleston. The case has been assigned to Circuit Judge Andrew Dimlich.
