Couple alleges home was damaged by Bath Saver, Ohio Bath Solutions

CHARLESTON – A Charleston couple allege their bathroom was damaged during the installation of a tub liner.

David Bailey and Kathy Bailey filed a complaint Nov. 15 in Kanawha Circuit Court against Bath Saver Inc., doing business as Bath Fitter, and Ohio Bath Solutions alleging negligence.

According to the complaint, the plaintiffs allege that on April 13, the defendants installed a tub liner in the bathroom of their residence. The plaintiffs allege that the installation process created extensive damage to their bathroom.

The plaintiffs hold Bath Saver Inc. and Ohio Bath Solutions responsible because the defendant allegedly improperly installed the tub liner at the bathroom and failed to disclose or misrepresent the price of goods and warranty information.

The plaintiffs request a trial by jury and seek compensatory and statutory damages, attorney's fees, costs and all other relief that the court may deem just and proper. They are represented by Michael M. Cary of Cary Law Office PLLC in Charleston. The case has been assigned to Circuit Judge James C. Stucky.
