Avenue Pizza alleged to owe more than $34,000 for goods

MOUNDSVILLE – A Moundsville restaurant is alleged to have failed to pay for goods delivered by a Pennsylvania company.

Reinhart Foodservice LLC Pittsburgh filed a complaint in Marshall Circuit Court against Avenue Pizza LLC and Derek Turkezer alleging breach of contract.

According to the complaint, the plaintiff alleges that on Jan. 30, 2017, the defendants received a $15,000 incentive payment and a one-time credit of $5,500 from plaintiff in exchange for purchasing goods from Feb, 1, 2017, through Feb. 1, 2022. The plaintiff also sold certain goods to defendants at a reasonable price, the suit states. 

The plaintiff alleges that Avenue Pizza breached the agreement in March 2017. After all proper credits for payments and/or returned merchandise for the goods sold and delivered is $14,705.32, plus the remaining incentive of $14,250 and $5,500 unearned credit extension, the total amount due and owing is $34,455.32. 

The plaintiff seeks judgment against defendant in the amount of $34,455.32, plus interest, attorney's fees, costs and any further relief to which plaintiff is justly entitled. It is represented by John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania. The case has been assigned to Circuit Judge Jeffrey Cramer.
