Former Heritage Center resident alleges negligent care caused injuries

CHARLESTON – A former resident of a Huntington skilled nursing facility has filed a suit over the care she received there.

Teri Newman filed a complaint on Dec. 4, 2017, in the Kanawha Circuit Court against Genesis Healthcare LLC; 101 13th Street Operations, doing business as Heritage Center; John Does 1-10; and unidentified entities 1-10 alleging negligence and other counts.

According to the complaint, the plaintiff alleges that between Aug. 25, 2016, and April 2, 2017, she a resident at defendants' Heritage Care nursing home facility because she was no longer competent to handle her own affairs due to dementia.

As a result of defendants' alleged negligence, she claims she suffered personal injuries and damages, including but not limited to the development of pressure sores, pain and infection. 

The plaintiff holds the defendants responsible because the defendants allegedly failed to hire and maintain sufficient staff, to provide the plaintiff adequate hygiene and sanitary care and receive timely and accurate care assessments.

The plaintiff requests a trial by jury and seeks damages in excess of the minimum jurisdictional limits of the court, litigation costs and all further relief to which she may be entitled under the law.
