THS Physician Partners alleged to have failed to accommodate former employee's disability

CHARLESTON – A woman alleges her Kanawha County employer terminated her because of her disability.

Teresa A. Ansell filed a complaint Dec. 5 in Kanawha Circuit Court against THS Physician Partners Inc. citing the West Virginia Human Rights Act.

According to the complaint, the plaintiff began her employment with the defendant in June 2015 as an applications information technology specialist. She alleges she was terminated in July 2017 while she was out on a medical leave for a chronic cough disorder.

The plaintiff holds THS Physician Partners Inc. responsible because the defendant allegedly failed to provide reasonable accommodation for her disability and terminated her because of her disability.

The plaintiff requests a trial by jury and seeks all damages, pre- and post-judgment interest, attorney's fees, costs and all issues triable by jury. She is represented by Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston. The case has been assigned to Circuit Judge Charles E. King.
