FAYETTEVILLE – A woman alleges she was terminated from her job because of her disability.
Crystal McCrackin filed a complaint in Fayette Circuit Court against American-Canadian Expeditions LTD, doing business as Ace Whitewater, citing the West Virginia Human Rights Act and the Wage Payment and Collection Act and the Workman's Compensation Act.
According to the complaint, the plaintiff alleges that during her five-year employment with the defendant, she was an ideal employee. She alleges that when a new manager arrived, she was given more work so the manager and another co-worker could do other activities, such as smoking illegal substances, while on the clock. She alleges she complained of the acts and was threatened. She alleges that after the manager learned of her health issues, her work load was increased to force her to resign. The suit states the plaintiff was terminated April 11, 2016.
The plaintiff holds American-Canadian Expeditions LTD, doing business as Ace Whitewater, responsible because the defendant allegedly terminated her because of her disability and discriminated against her because of her disability and age.
The plaintiff seeks damages, back pay or any legal relief, front pay, punitive damages, interest, court costs and any further relief this court grants. She is represented by D. Adrian Hoosier II of Lord Hoosier PLLC in Charleston. The case has been assigned to Circuit Judge John W. Hatcher Jr.
