Resident of nursing home alleges negligence caused injuries

WAYNE – A Kanawha County man alleges a nursing home failed to provide him a safe environment.

Willie Hampton filed a complaint on Dec. 22, 2017, in the Wayne Circuit Court against 1000 Lincoln Drive Operations LLC, doing business as Valley Center, and Genesis Healthcare LLC alleging negligence and other counts.

According to the complaint, the plaintiff alleges that during his residency at defendants' nursing home facility beginning in Feb. 21, 2017, he suffered urethral trauma and hemorrhagic shock secondary to urethral bleeding. 

The plaintiff holds 1000 Lincoln Drive Operations LLC, doing business as Valley Center, and Genesis Healthcare LLC responsible because the defendant allegedly failed to provide a sufficient number of staff, failed to provide him with adequate supervision and failed to provide adequate care and treatment.

The plaintiff requests a trial by jury and seeks all damages as allowed by law, litigation costs and all other relief as the court sees fit to award. He is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston. The case has been assigned to Circuit Judge Darrell Pratt.
