Man sues after he slipped and fell on sand at Lowe's

WHEELING – A man is suing Lowe’s Home Centers after he claims he was injured due to sand on the floor of its Wheeling store.

John Doe Corporations and John Doe Tortfeasors were also named as defendants in the suit.

On Sept. 18, 2015, Robert Williams Sr. was at Lowe’s in Wheeling when he noticed some other patrons near the front cash registers who were purchasing a large amount of what appeared to be sand for a children’s play box, according to a complaint filed Sept. 14 in Ohio Circuit Court and removed to federal court on Jan. 11.

Williams claims the patrons were having difficulty with the sand at the register and an employee was assisting the customers with their purchase of the sand.

The plaintiff continued past the patrons and Lowe’s employee and proceeded with his shopping and was in the store approximately 20 to 30 minutes, according to the suit.

After Williams completed selecting his items, he proceeded to the checkout area and, as he approached the cash registers, he turned to go to one of them and his foot slipped on a grainy substance on the floor that felt like sand, according to the suit.

Williams claims he fell to the ground, striking his left side, his head hit the floor and he lost consciousness.

As a result of the incident, Williams suffered a head injury resulting in a concussion; neck, shoulder and back pain; mental and physical pain; suffering; and anguish, according to the suit. Williams also incurred significant medical bills.

Williams claims Lowe’s was negligent and caused him to fall on the unsafe floor.

Williams is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Amy Pigg Shafer of Shafer Law Offices.

Lowe’s is represented by Andrew B. Cooke of Flaherty Sensabaugh Bonasso.
