Construction worker seeks damages from AEP, AP over fall allegedly caused by shock from lines

PINEVILLE – A Wyoming County man alleges he was caused to fall from a roof of a home he was working on because of an electric transmission line.

Larry Keith Morgan and Carrie Marie Morgan filed a complaint Jan. 16 in Wyoming Circuit Court against Appalachian Power Co., American Electric Power Co. and Daryl and Letha Cline alleging negligence.

According to the complaint, the plaintiffs allege that on Nov. 14, 2016, Larry Morgan was providing construction services to the Cline residence when he came into contact with a low-hanging electric transmission line owned and maintained by defendants AP and AEP. He alleges he received an electric shock, which caused him to fall from the residence's roof and suffer injuries to his shoulder, arms, knees and hands. 

The plaintiffs holds Appalachian Power Co., American Electric Power Co., and others responsible because defendants Cline allegedly failed to take reasonable precautions when they allowed plaintiff Larry Morgan to install metal roofing without notifying him of the dangerous condition and defendants AP and AEP breached their duties to inspect and maintain their electric transmission lines.

The plaintiffs request a trial by jury and seek all damages, plus interest, costs, attorney's fees and any further relief as the court deems just and proper. They are represented by Kyle G. Lusk, Matthew A. Bradford and Brandon L. Gray of Lusk & Bradford PLLC in Beckley. The case has been assigned to Circuit Judge Warren R. McGraw.
