Power of attorney alleges Harper Mills did not provide safe environment for resident

BECKLEY – A Fayette County woman engaged as a power of attorney alleges a Beckley nursing home facility failed to provide a safe environment.

Mary E. Neff, power of attorney of James D. Neff Sr., filed a complaint Jan. 17 in Raleigh Circuit Court against Riparian Investments LLC, doing business as Harper Mills LLC, and Stonerise Healthcare LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 17, 2017, James D. Neff Sr. was admitted to Harper Mills for rehabilitation and assistance. During his residency at defendants' facility, the suit states he suffered a left periprosthetic femur fracture that required surgical intervention.

The plaintiff holds Riparian Investments LLC and Stonerise Healthcare LLC responsible because the defendants allegedly violated James Neff Sr.'s resident's rights to be free from abuse, neglect and mistreatment; his right to be adequately informed of his medical condition and the proposed treatment; and failed to provide an accident-free environment.

The plaintiff seeks all damages as allowed by law and all other relief that the court sees fit to award. She is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston. The case has been assigned to Circuit Judge John A. Hutchison.
