More than $50,000 sought from Dan's Marine Service, Tygart Lake Marina over alleged boat damages

GRAFTON – An insurance company alleges a storage facility owners' failure to clear snow from its roof caused damages to a boat.

Progressive Classic Insurance Co., assignee of Robin Hardman, filed a complaint Jan. 17 in Taylor Circuit Court against Dan's Marine Service Inc. and Tygart Lake Marina LLC alleging negligence.

According to the complaint, the plaintiff alleges that plaintiff's assignor's boat was stored at defendants' storage facility located in Grafton. The suit states that on or about Jan. 24, 2016, the roof's facility failed due to snowstorm and caused debris to fall on and damage plaintiff's assignor's boat. The plaintiff alleges it suffered financial losses of $56,943.49.

The plaintiff holds Dan's Marine Service Inc. and Tygart Lake Marina LLC responsible because the defendants allegedly failed to inspect and promptly clear snow from the roof of their storage facility.

The plaintiff requests a trial by jury and seeks judgment against the defendants in the sum of $56,943.49, plus interest and costs expended for this action. It is represented by Steven M. Recht of Recht Law Offices in Weirton. The case has been assigned to Circuit Judge Alan D. Moats.
